Ending a tenancy in Dubai

Your contract decides your notice period. A valid lease cannot be ended early by one side alone, and neither law read here fixes an early exit penalty.

What people say

"You must give 90 days notice."

"Breaking a lease costs two months' rent."

"Landlords and tenants both owe 12 months."

What the texts say

90 days. As amended in 2008, Article 14 sets 90 days for a party who wants to amend lease terms, unless agreed otherwise. The original 2007 wording also covered a party not wishing to renew, and the Land Department's tenancy guide still reproduces it. So treat 90 days as common and possible, not as a settled rule on tenant exit. Dubai Law 33 of 2008 DLD tenancy guide

Two months. Neither law text read here sets a penalty figure. Any penalty comes from your contract or what you agree with the landlord. Dubai Law 26 of 2007

12 months. This binds the landlord, for end-of-lease eviction on grounds such as demolition, major repairs, own use or sale, served through a Notary Public or by registered mail. It is not a tenant notice rule. Dubai Law 33 of 2008

These are English translations, and the law's own note says the Arabic prevails. This is a plain reading for planning, not legal advice. Your contract comes first, so read its notice and early-exit clauses and ask the Rental Disputes Center or a lawyer if they are unclear.

Leaving at the end of the term

Tell the landlord in writing, by the contract's deadline. Mover guides often quote 1 to 3 months. Yours may differ, so read it.

Do not simply stay on. If the term ends and you remain without objection from the landlord, the lease renews for the same term or for one year, whichever is shorter, on the same terms. Dubai Law 26 of 2007

Leaving early

A valid lease cannot be ended during its term by one side alone. It ends by mutual consent or under the law. So you need an agreement, usually a written one, which sets what you pay and when. Look for an early termination clause, then negotiate from there. A replacement tenant is a practical thing to offer. Dubai Law 26 of 2007 Dubai Land Department FAQ

Handing back

The unit goes back as you received it, except for ordinary wear and tear. The Land Department says minor marks from normal use, such as scratches from moving furniture, are not yours to repair, and advises proving the condition at handover. Dubai Law 26 of 2007 Dubai Land Department FAQ

  • Find your move-in photos or inspection report.
  • Take dated photos of every room after cleaning, including inside cupboards and of any meters.
  • Do a joint walk-through and get any claims listed in writing.
  • Get written confirmation of the handover date and when the deposit comes back.

Ejari

Tenants and landlords can both submit Ejari cancellation requests through the Dubai REST app. Dubai Land Department FAQ DEWA shares move-out information with the Land Department, and when an owner cancels Ejari, DEWA tells the tenant to deactivate. DEWA move-out guide

The security deposit

The landlord may hold a deposit for maintenance and must refund it, or what remains, when the lease ends. Dubai Law 26 of 2007 Ask for any deduction to be itemised. Get the refund route agreed before you fly: a cheque is little use if you have closed your account.
